Definition of the Legal Power of the European Central Bank

欧洲中央银行的权力主要来源于《欧洲联盟条约》、《欧洲联盟运行条约》、"欧洲中央银行体系和欧洲中央银行规约"以及欧盟内部立法。以权力来源角度而言,的确有部分权力来源于协定或议定,从权力的不同层面以及权力的法律规制视角研究发现协定权力或议定权力实际上均属于法定权力的范畴。因此将欧洲中央银行的权力界定为法定权力才是最为准确的。

The power of the European Central Bank is the main source of Treaty on European Union,Treaty on the Functioning of the European Union,protocol on ＂ the statutes of the European system of central banks and the European Central Bank ＂ and the EU legislation. In terms of power source,there are indeed some of the powers that come from either agreements or negotiations. But this paper finds that both agreement or negotiation actually belong to the areas of legal power by studying the different levels of power and its relevant legal regulations. So the power of the European Central Bank is defined as the legal power to be the most accurate.
