社会快速发展的当下中国,脑死亡尚未立法及相关医学教育理念的落后,在一定程度上增加了案件与纠纷的处理难度。但法律工作者和医学生使用的关于死亡诊断的标准仍然停留在心性死亡阶段,难以适应现实需求。藉于此,应尽快推动脑死亡立法工作的开展,包括提升广大民众对脑死亡概念及相关知识的认知水平,法学界及医学界人士的积极呼吁,司法部门在相关具体案件的争议调解中也应以更务实的态度推广脑死亡诊断标准的应用。

With the rapid development of the society in current China, no brain death legislation and behindhand medical education concept increase the difficulty in case and dispute disposal to some extent. Death diagnosis standards acquired by the legal workers and medical students are still cardiac death, it is difficult to adapt to the reality demand. In view of this, it is an urgent job to promote the brain death legislation work including ： improving the cognitive level of brain death concept and related knowledge in general publics including the medical workers; promoting the process of brain death legislation work by active appealing of the legal and medical professionals; promoting of brain death diagnostic criteria application in more pragmatic attitude through the judicial departments in the dispute mediation of relevant specific cases.
