后农业税时代农地调整与农地流转法律问题研究——基于广东省三县六镇十二村的调查报告

Farmland Adjustment and Farmland Transfer in Post-agricultural Tax Era:Based on a Investigation of Three Counties,Six Towns and Twelve Villages in Guangdong Province

在党的十八届三中全会《决定》的背景下,为步入后农业税时代的我国从法律方面推进新农村建设,加快农村集体经济发展提供第一手资料和现实依据,课题组采取社会实证调研分析方法对农地调整和农地流转法律制度的运行情况进行考察,特对广东省三县六镇十二村开展调研。调查表明,我国在实行"大稳定、小调整"的策略下,应逐步推行地租制以弥补"增人不增地,减人不减地"政策的缺陷,同时丰富农地流转方式,并适当简化其流转程序,尊重村民的行为自治,充分发挥村集体的统一领导作用,建立抛荒地预警和微调机制,实现土地承包经营权长期稳定的现实与法律目标。

Under the guide of the＂Decision＂of the Third Plenary Session of the 18 th Central Committee of the CPC,to promote new countryside construction and to provide first hand materials as well as practical basis for the quickening of rural collective economy from the aspects of law in the post-agricultural tax era,the research group investigated the legal system operation of farmland adjustment and farmland transfer through empirical research on three counties,six towns and twelve villages in Guangdong Province.The results indicate that when applying the strategy of＂overall stabilization and little adjustment＂,China should carry out rent system gradually to cover the shortage of policy of＂do not increase the amount of land for the population growth and do not minimize for depopulation＂,diversify the farmland transfer method and simplify the transfer procedure,respect the village self-governance to finally give play to the centralized leadership of village collectives.In addition,China should establish the warning and fine-tuning system of pastureland to realize the long-term stability of contractual management right of land.
