摘要
近年来,我国医患纠纷频发,医生的劳动权益屡屡受侵。医生劳动权包括就业权、劳动报酬权、休息休假权、劳动安全卫生保护权、提请劳动争议处理权、从事医学研究、接受继续医学教育、团体交涉权、集体争议权等,医生劳动权保护面临着职业安全权受到挑战、休息休假得不到保障、工资收入与劳动不成正比、人格尊严受到侵害、提请劳动争议处理权行使不畅等问题,明确医生工作的劳动属性、完善医生劳动权益保护的实体法,合理配置医疗资源,提高法律意识,真正实现管理法治化等措施从而保障医生的劳动权。
In recent years, with frequency of medical disputes in China, doctor's labor rights were infringed repeatedly. Doctor's labor rights include employment right, labor remuneration right, rest and vacation right, labor safety and health protection right, labor dispute resolution right, right to engage in medical research, right to accept continuing medical education, right of collective bargaining, collective dispute right etc. The protection of doctor's labor rights is facing plenty of problems: occupation safety and security is challenged;rest and vocation can't be guaranteed;income is out of step with work;personality dignity is abused;and;labor dispute resolution right fails in execution. It's necessary to clarify the attribute of doctor's labor, improve the substantial law of protecting doctor's labor rights, reasonably allocate the medical resources, strengthen the legal awareness, and realize management legalization to protect doctor's labor rights.
