当今社会法律特征的二分界归审视

A Survey of the Dichotomy of the Legal Characteristics in Today's Society

从法律与社会的互动关系看,探视当下的社会问题可以法律特征的内涵与外延不同为标准,进行法律社会特征的二分界归1划分。传统法律特征分类中的规范性、普遍性与国家意志性可划归于指令性特征部分,而法律的强制性、程序性与可诉性则可归属救济性特征。指令性特征主要为人们提供规范指引,以及违反指令后的后果,包含着规范性、普遍性与国家意志性的精神要义;法律的救济性特征则是指令性特征实现的保障,而救济的全部内容必须要经过一定的司法程序才能实现。

From the interaction relationship between law and society,the inquiry of the social problems today could be performed in accordance with the difference between the connotation and denotation of legal characteristics,and the social characteristics of laws could be classified anew by a dichotomy.The features as being normative,universal and the will of the state in traditional classification can all be incorporated into the mandatory part,while the features as being mandatory,procedural and justifiable into the part of relief.The mandatory characteristics mainly supply standard guidance and the consequence of violation laws to people,including the spiritual main ideas of normalization,universality and the will of the state;and the relief legal characteristics are the guarantee for realizing the mandatory legal characteristics,while the whole contents of relief should be realized through certain judicial procedures.
