社区矫正法典化的若干问题探究

无论是社区矫正的现行立法、党的政策,还是对于社区矫正十余年的试点与研究,专门为社区矫正立法的法典化时代已经到来。但对于经验的总结思考,社区矫正法典化还有一系列的问题亟待解决,如社区矫正的定性问题、适用范围、主体问题、程序问题、监管问题、权利救济问题。通过对现有主要学者讨论的观点进行列举和对比,进而评析出对我国社区矫正法典化的若干启示及建议,可以为法典化走上快车道提供智力支持。
