摘要
我国公务员考试录用过程中的歧视制约了公务员制度的健康发展。文章分析了公务员考试录用歧视的概念、特征及分类,认为政治法律制度的缺失是公务员考试录用歧视产生的主要原因,指出《公务员法》关于考试录用资格条件的限制与《宪法》有关规定相抵触,《公务员录用规定(试行)》《公务员考试录用公告》关于考试录用资格条件的限制与《宪法》《立法法》《公务员法》相关条文存在冲突,公务员考试录用歧视争议欠缺必要的救济途径,提出了法律规制公务员考试录用歧视的立法建议与措施。
Discrimination in China’s civil servant test restricts the healthy development of the civil service system.On the basis of analyzing the concept, characteristics and classification of discrimination in China’s civil servant test, the paper proposes that lack of political and legal system is the main reason for discrimination, and points out that the relevant provisions of the restrictions on the qualifications of Civil Servant Law are incompatible with those of The Constitution; the relevant provisions of the restrictions on the qualifications of Provisions on Recruitment of Civil Servants ( for Trial Implementation) and Civil Service Examination Recruitment Notice are incompatible with those of The Constitution, Legislation Law, and Civil Servant Law.Since the discrimination dispute of civil servant test lacks necessary relief channels, the paper puts forward some legislative proposals and measures of discrimination in civil servant test.
