城市管理行政处罚的立法研究——基于国内六部地方性法规的实证分析

Legislative Research on the Urban Management Administrative Penalty——Based on Empirical Analysis on Six Domestic Local Regulations

由于城市管理涉及大气环境、市容卫生等诸多方面,故城市管理中的行政处罚立法极为重要。文章以六部城市管理行政处罚立法为背景,以当前地方性法规中的行政处罚设定现状为出发点,分析其中存在的问题,并对完善城市管理行政处罚的设定提出一些建议,旨在科学合理地设定城市管理行政处罚,保证地方性法规有效实施。

Since the city management involves many aspects,such as atmospheric environment,the city sanitation,etc.,the administrative penalty legislation is very important in urban management.Based on the background of the six urban management administrative penalty legislation,the article takes the current status of local rules and regulations of the administrative penalty as a starting point,analyzes the problems,and puts forward some suggestions on perfecting the setting of the urban management administrative penalties.So the article aims to establish a scientific scale of setting city management administrative penalty so as to ensure the effective implementation of local regulations.
