我国被征地农民社会保障法律制度的完善路径

On Development of Social Security System for Land-Expropriated Farmers

城市化和工业化是我国社会经济发展的必经阶段,在我国城市化、工业化建设进程中对土地的需求量越来越大,大量农村集体土地被征用,从而导致被征地农民数量急剧增长,他们已经成为城市化进程中的一个特殊群体。目前我国被征地农民社会保障制度仍处于探索阶段,并没有形成一个统一完善、规范合理的法律制度来作为解决问题的依据。为此,应明确土地产权,加强土地立法,以进一步建立健全完善的被征地农民社会保障制度体系,为被征地农民提供安全有效的保障措施。

In the process of urbanization and industrialization,the inevitable stage of economic development,a large number of rural collective lands have been expropriated,which may lead to a sharp increase number of landless farmers who have become a special group in the urbanization process. At present the Chinese social security system for land-expropriated farmers which is still in the exploratory stage has not formed a unified reasonable legal system to solve the problem. This paper proposes to define the land property right, strengthen the land legislation and further improve the security system so as to provide safe and effective safeguard measures for land-expropriated farmers.
