论我国《监狱法》的修改与完善

On the Amendment and Perfection of the Prison Law in China

在《监狱法》的具体内容上,笔者对我国《监狱法》存在的问题进行了归类分析,分为三个类别,即协调问题、细化问题以及空白问题。而协调问题又分为法律部门之间的协调,即法律衔接和法律重复问题,以及法律部门内部内容之协调问题。细化问题针对我国《监狱法》部分内容过于笼统,原则性不强而提出的,具体又包括期间问题、经费问题、监狱工作人员的设置和分类问题等13个方面。空白问题是针对目前出现的许多新情况、新问题而《监狱法》却并无相应规定的立法空白所提出的。包括监狱企业、罪犯危险性评估、外籍犯管理等9个方面。在指出每一方面问题的同时,笔者提出了相应的完善建议。全文的最后一部分中,笔者对《监狱法》的体系定位进行阐述,得出《监狱法》系刑事执行法律体系的组成部分,属于《刑法》、《刑事诉讼法》的下位法,其规定不能与后两者的规定相抵触的结论,并对监狱法律体系进行了设计。

The amendment of Prison Law should be in accordance with the integration in criminal fields. On the detailed content to be modified,it should be divided into 3 parts： coordination problems,the details and the blanks. Coordination problems include departmental coordination and content coordination. Detailed content problems include period problems,cost problems,the staff＇s setting up and classifying,and other 10 aspects as well.The blank problems include prison enterprise,risk assessment of criminals,foreign criminals＇ management and other 6 aspects.
