习惯法是人类社会最早的法。如果没有习惯法的产生和发展 ,就不会有现代文明社会的法律。蒙古族习惯法具有独特的产生和发展规律 ,是北方马背民族法律典范 ,是了解北方各民族法律文明和法律文化的纽带。研究探讨蒙古族习惯法 ,对于正确理解蒙古社会制度及其性质 ,正确理解蒙古法律文化 ,实现西部大开发战略决策和现代化建设 ,促进少数民族地区经济文化及社会发展 ,促进牧区经济的市场化、现代化。

There would be no emergence and development of the present laws in modern society.The Mongolian customary law,with its unique emergence and development,is a model law of the northern horse back ethnic groups and can serve as a link in understanding the legal society and law culture of the northern ethnic groups.Studying the Mongolian customary law can help us to have a better understanding of the Mongolian social system,its characteristics and Mongolian law culture.It is also of great significance to us in our implementing western development strategy,realizing four modernizations,promoting the economic,cutural and social devolopment and bringing about market economy and modernization in pastoral areas.\;
