国家治理新境界对我国全面依法治国的挑战及其应对

The Challenge and Countermeasure of China's Comprehensive Rule of Law Brought by the New State of National Governance

全面依法治国是开启国家现代化治理新境界的金钥匙。法治对治理的决定性功能包括生成法治秩序、确立愿景目标和提供根本保障。当前,我国全面推进依法治国面临的现实挑战主要有:国家立法不尽完善、行政执法水平不高、司法亟待去行政化以及民众法律信仰缺失。因此,完善法律体系、建设法治政府、深化司法改革和重建法律信仰是加速推进全面法治的战略举措。

Comprehensive rule of law is the golden key to open the new state of modernization of national governance. The decisive function of the rule of law towards governance includes generating the legal order, establishing vision target and providing fundamental guarantee. At present, the real challenges facing China＇s comprehensive rule of law are： imperfect national legislation, lower level of administrative law enforcement, urgent needing of independent judiciary system, and people＇s lack of belief in law. To improve the legal system, build a government ruled by law, deepen judiciary reform, and rebuild legal belief are the strategic moves to accelerate the comprehensive rule of law.
