当今学术界对案件事实处理中经验法则的认知过于碎片化，为此须转换一种研究视角，从事物两重性的角度出发，对经验法则的相关议题进行整合性地再认识。这样一方面走出经验法则认识的循环论证泥潭，另一方面达到其融贯应用的效果。经验法则盖然性困境的克服彰显的是接近其自身的真实有效性，而经验法则运行会对法官心证活动产生确信与规制的双重效果，相应的经验法则适用要受到民意的合理引导，才能较好发挥其对司法裁决的检验功用。这种对经验法则自身属性、运行过程、作用限度的整合性认知，有助于改善和提升法官认定事实的能力。

The cognition of empirical law in case facts handling tends to be fragmented in the academic circle nowadays, therefore, it is of great necessity to shift the research perspectives and attain an integrated re-cognition of the relevant issues concerning empirical laws from the dual nature of things, which on the one hand helps the empirical law cognition out of the circle of argument, and on the other hand achieve the effect of applying empirical law soundly. With Difficulties of probability overcome, the real validity of empirical laws is revealed, and the operation of empirical laws will produce the double effect of conviction and regulation to the judge’ s evaluation of evidence. The applicability of empirical laws should be in turn reasonably guided by public opinion, which will better carry out the testing function on judicial decisions. This integrated cognition of empirical law from its nature, its operation and its functions will help improve the ability of the judges in ju-dicial decision.
