摘要
基层政府在城市拆迁中扮演着拆迁者和维护者的双重角色,违背了基层政府维护公共利益的职能,导致基层政府中的一些官员运用行政权力进行寻租,影响了城市拆迁的有序进行。在城市拆迁过程中,尚存在着资源浪费、环境污染、拆迁补偿不到位等问题。因此,要规范城市基层政府的拆迁行为,需从拆迁制度、拆迁法律和监督机制等方面加强建设,实现政府职能的转变。
Local governments play a dual role of demolish and maintain in the urban demolition,violating the basic function of local government to safeguard the public interest,lead to some of officials in local government using administrative power rent- seeking,affecting the urban demolition. In the course of demolition in the city,there are some issues with a waste of resources,environmental pollution,compensation is not in place. Therefore,it is that regulate the behavior of urban local governments in the demolitiong need to strengthen the construction from the aspects of the demolition institution,demolition legal system and supervision mechanism,achieving the transformation of government functions.
