农地流转与收益分配的制度障碍及路径探析

Researches on the Reform of the Rural Land Transfer Income Distribution

随着土地的市场化价值日益凸显,目前农地流转的速度要远远快于收益分配的制度设计,农户和农村集体经济组织的收益分享量问题在法律中找不到清晰界定,收益分配关系依旧处于无序状态。本文在对近年来农地流转和收益分配的现状与特点进行梳理的基础上,在理论方面为农地流转中的增值收益分配主体及分配依据的确定提供参考;主张产权立法并建立农地发展权制度;鼓励推进农地股份化、信托化等新型土地流转方式;积极探索符合农村社会发展和农民实际需要的收益分配模式,以解决区域内征地补偿的相对公平问题。

With the market value of the land becoming increasingly prominent,the current rural land transfer is much faster than the design of the income distribution system.The problems of the amount of revenue sharing of the farmers and the rural collective economic organizations are not defined clearly in the law.And the relationship of the income distribution is still in a state of disorder.This paper sorts out the current situation and characteristics of the recent transfer of rural land and the income distribution,which in theory provides a reference for the value added income distribution and the determination of the basis of distribution in the transfer of rural land.It holds that property legislation and the system of the rural land development rights is needed,the new land transfer modes of the stock system and the trust system of the rural land should be encouraged,the type of income distribution according with the rural social development and farmers＇ actual needs should be explored to solve the problems of the relatively fair in the intraregional land expropriation compensation.
