论审判中心主义视角下侦诉关系之重构

On the Reconstruction of the Relationship Between Police and the Prosecution at the Trial Center Perspective

贯彻审判中心主义作为司法体制改革的突破口,对整个刑事诉讼程序具有广泛而深刻的影响。审判中心主义并不否定审前程序的重要性,与检察机关对审判活动的诉讼监督并不矛盾,其核心点在于完成审前程序的诉讼化构造,实现审判本位的回归。侦诉机关的追诉行为要得到审判的最终确认,就必须以审判为方向和标准开展侦诉工作。而我国当前的侦诉关系存在着权力制约失衡、监督滞后乏力等问题,要革除弊端、贯彻审判中心主义,就必须将目前侦查中心下地位畸变的侦诉关系变为审判中心主义语境中检察机关引导下的侦诉协作关系,加强检察监督力度。

While China＇s current relationship between investigation and litigation has many imbalance in the power restriction and supervision problems, to carry out the trial center doctrine, the relationship between Investigation and prosecution must turn into collaborative relationship under the guide of investigation, strengthen proseeutorial supervision.
