An Analysis of the Development of the International Legal Personality of the International Organizations

随着国际组织在现代国际社会中兴起,国际组织的国际人格问题在当代国际法问题研究中日益凸显。国际组织的国际人格源于国际组织的国际法律实践,目前仍处于逐步发展的过程之中,具有自身的局限性,还有待进一步的完善。笔者针对国际组织的国际人格的生成现象进行了较为系统的研究,重点分析了国际组织的国际人格的生成基础、生成过程、生成机制和生成后果,初步揭示出国际组织的国际人格的基本生成规律。

With the development of the international organizations in the modern international community, the study of the international legal personality of the international organizations is attracting more attention within the field of the international law. The international legal personality of the international organizations roots in the practice of the international law and is still immature with some limitations, which needs improvement. This paper systematically studies the development of the international legal personality of the international organizations with a focus on its foundation, development process, mechanism and influence, and explores the fundamental principles of how this personality is established.
