从知识产权角度浅析仿制药企业的发展之道

Future development of the generics business from the point view of intellectual property

随着公共健康利益需求和国家对药品质量控制要求的提高,仿制药企业的发展需要加速技术进步和产品质量升级,更要面对无可回避的知识产权问题。本文拟基于知识产权角度从以下4个方面浅析仿制药企业的发展之道:仿制药企业知识产权意识的培养与运用;自主知识产权的发现、形成、布局与积累;药物开发过程中的专利信息利用以及可能的专利挑战。

With the interest of public health needs and the improvement national drug quality control requirements,the development of generic drug companies need to accelerate technological progress and upgrade product quality,and also to face the issue of intellectual property rights unavoidably. Based on the intellectual property rights of generic drug companies,we analyzed the perspective of development from the following four areas in this paper. Namely,generic drug companies should cultivate and utilize awareness of intellectual property rights;use patent information in the drug development process; discover,form,layout and accumulate proprietary intellectual property rights; and take part in patent challenges as far as possible.
