The second revision of the patent law had successes in three aspects: defining the subject, reinforcing protection and improving the process. But there are still a lot of defects in dealing with the article14 of the law compared with the requirement of socialist market economy and TRIPS. It is recommended that article49, which is 'compulsory license for the interest of the country or the public'of the law should cover the article14.
