摘要
分类管理已经成为我国民办教育改革的重要政策选择。论文结合"十二五"试点改革,对《民办教育促进法修正案(征求意见稿)》提出的非营利性与营利性分类管理方案进行剖析,指出应该立足当前我国民办教育"合理回报"的国情基础,允许民办教育领域的市场作用,认可市场公益性存在。论文对该方案框架下带来的非营利学校产权捐赠、取消合理回报、清算后剩余财产的不能分配等重要问题进行分析,建议国家科学定位新时期民办教育的发展战略地位,进一步扩大试点,循序渐进推进分类管理改革,及时研究制定民办学校的分类发展政策,促进民办教育的可持续发展。
Classified management has become an important policy in the reform of China's non-governmental education. This paper presents an analysis of the classification management framework from the under-discussion Amendment of Non-governmental Education Promotion Law, and points out that there should be a recognition of the market force and its publicity. Under this framework, key issues such as the donation of property, the cancellation of reasonable profit and the distribution of residual property for non-profit schools are also discussed. The paper proposes a new strategic orientation for non-governmental education, more reform programs and more policies for enhancing the sustainable development of non-governmental education in China.
