从中国的现实出发,面对中国法治生成的既成事实,建设中国特色社会主义法治体系,是法治中国建设的现实起点。西方既成的法治发展历史不是法治发展的必然史,更不是法治本身的内在逻辑,中国应当结合自身的实际,探索适合自身法治发展的具体道路。建设中国特色社会主义法治体系需体现中国的历史、中国的现实、中国的文化特质等中国元素,同时吸纳人类一切优秀的法治文化,如此方能使中国的法治建设不断开放发展并充满活力。

Based on the present reality of China,facing the accomplished fact of the generation governed by law in China,to solve the realistic question of the disadvantages governed by law in China,and to establish the socialist governed of law with Chinese characteristics-they are the realistic starting-points of China governed by law.The development logic governed by law in the west is not the logic of governed by law itself.China ought to unify its own actual situation to explore the path which is suitable for its own development governed by law.The establishment of the socialist governed of law with Chinese characteristics should reflect the history,the reality and the cultural traits of China,and should simultaneously absorb the outstanding cultures all over the world.Only in this way can？the governed by law of China possesses inclusiveness and openness and is full of vitality.
