摘要
物权公示是物权法的基本原则之一,而物权公示的原因在于保护交易安全。虽然我国《物权法》第106条没有将物权公示明确规定为善意取得的构成要件,但基于物权公示的功能,其应是物权善意取得的前提性要件。物权公示的方法是法定的,占有虽然存在于动产物权和不动产物权之上,但占有并非所有物权的公示方法,占有具有不同于公示的功能。无需登记的不动产物权不存在公示方法,其不具备适用善意取得的要件。采登记对抗主义的物权公示方法为登记,在无处分权人为登记的主体时,能够适用善意取得。
Property publication is one of the basic principles of Property Law.There are misunderstandings on why the real right needs to be publicized.The purpose of property publication is to protect the transaction security.Although the article 106 in Chinese property hasn't ruled clearly that bona fide acquisition is the requirement of property publication,it is the precondition base on its function.The method of property publication is legal.Possessing exists in movable and immovable property,but it's not the way of demonstration of possession.The function of possessing is different from demonstration's.Real estate without registration doesn't have public methods.It doesn't have good faith requirement and can't apply to bona fide acquisition.The method of property publication that adopted registration antagonism is registration.Unauthorized person could apply to bona fide acquisition when he is the main body of the registration.Whether this kind of situation can be acquired in good faith,other requirements need to be considered.
