论陪审职能新格局下专家陪审之引入——专家陪审价值与制度的再思考

On the Introduction of Expert Assessors into the New Pattern of Jury System

专家陪审是对人民陪审员制度民主与公正价值的一种补强,可有效缓解现行人民陪审员制度在专业技术性问题审理中的认知困境。我国建立专家陪审制度顺应人民陪审员只参与事实审的职能改革方向,是事实审改革的重心之一,有着良好的实践基础。通过引入专家陪审丰富人民陪审员制度,既保障当事人充分行使辩论权,又可以使鉴定、专家辅助人等专家参与审判的制度效能得到更好的发挥。应在合理分配职权的基础上完善相应的组织、运行与监督机制,以发展符合我国国情的专家陪审制度。

Expert assessors increase the democracy and justice of people’s jury system,and can effectively alleviate the current plight of the people’s jury system in professional knowledge.The expert assessors system conforms to the reform of people’s jury only getting involved in facts verdict.With the introduction of expert assessors into the present people’s jury system,the rights of the parties concerned in defending for themselves are better guaranteed,and the institutional efficacy can be more fully exerted.A jury system involving expert assessors in line with China’s national conditions should be established on the basis of a reasonable allocation of functions and powers.
