摘要
对于抵押物的转让,我国的民商事立法在不同的时期有不同的法律规定。由于物权法第一百九十二条第二款规定的核心用词为"不得转让",引起了学界对未经抵押权人同意,抵押人擅自转让抵押物合同效力问题的争论。本文认为抵押人擅自转让抵押物的合同有效。司法裁判时应尽量注意相关法律适用上的体系性协调,对《物权法》中限制抵押物转让的条款应作符合整体价值目标的解释。
For the transferring the mortgaged property, regulations on different periods. Because the Property Law Chinese civil and commercial laws have different of the People' s Republic of China makes use of "no transfer", it causes the debate about contract effectiveness on transferring the mortgaged property without consent. This paper argues that it is effective on transferring the mortgaged property without consent of mort- gagee. Judicial referee should be aware of the coordination on relevant applicable law system. The regulation of limit of transferring the mortgaged property should be explained according to the overall value target.
