城市规划区重叠现象的几个法律关系研究

On some legal relations in overlapping phenomena in urban planning districts

依据《城乡规划法》相关规划区的概念、规划编制及实施管理规定,分析了规划区重叠的三种情况,并列举了规划区重叠的三个法律问题,从避免重复划定、城乡统筹发展、细化相关条文三方面,提出了解决城市规划区重叠问题的建议。

Referring to the concepts of the related planning districts, planning compilation, and implementation administration in Urban and RuralPlanning Law, the paper analyzes the three circumstances in the overlapping planning districts, lists the three legal issues in the overlappingin the districts, and points out some solutions to the overlapping districts from avoiding the overlapping classification, promoting coordinative developmentof urban and rural areas, and refining related clauses.
