摘要
2014年北极5国以北冰洋公海渔业管理"领导者"的姿态在其联盟会议上达成北冰洋公海渔业临时措施协议,并着力向国际社会推广该协议。北极5国在北冰洋公海渔业管理方面表现的"领导者"姿态由来已久,同时排斥其他利益相关方参与管理机制的构建,其单边主义行为的形成有其深刻的背景和原因。本论文以《联合国海洋法公约》与《鱼类种群协定》为视角,论述北极5国北冰洋公海渔业管理"领导者"地位的合法性,并在此基础上探讨中国的应对。
Acting as the steward for high seas fisheries management in the Central Arctic Ocean (CAO) , the Five Arctic Ocean Coastal States (A5) has agreed internally on interim measures for this area, and make endeavors to encourage other states to take measures consistent with interim measures. A5 has long been trying to establish its stewardship in the high seas fisheries management in CAO, denying other stake holders' involvement in constructing its management regime, a unilateralism which originates from A5's efforts in asserting its role as the CAO steward. An analysis will be conducted in the paper about the legitimacy of A5’s stewardship in CAO fisheries management in the light of "United Nations Convention on the Law of the Sea" (UNCLOS) and "The Straddling Fish Stocks Agreement for the Implementation of the Provisions of UNCLOS" (AFS) , two key international fisheries laws. China's response is also discussed.
