英语法律汉译中“得”字的应用及其文体学意义

The Use of "de" in Translated Laws and Its Stylistic Significance

"得"字的肯定式曾经是法律语言中的惯常用法,但在我国现行制定法中极少出现,而在由英语译成汉语的法律——尤其在翻译年代较早的法律——中使用较多。本文据调查认为,该词在汉译法律中的使用是过去法律汉语风格的一种孑遗,不符合我国社会主义法域中法律汉语的规范。本文预计,如果法律汉语未来的发展过程中不出现该用法的复古,此种用法将逐渐消失。

The word de（得） in its affirmative form was historically common in texts of law but is rare-ly used in current PRC statutes. However, such usage can still be frequently seen in many translated law texts-especially in those translated in the past. An investigation indicates that its frequent use in law trans-lation is a ＂local＂ continuation of old Chinese legalese and is non-standard in China＇s socialist law territory. We believe that the use is becoming obsolete, unless it is somehow revived.
