教育立法需要更加广阔的“一揽子”思路 被引量:1

摘要 《教育法律一揽子修正案(草案)》的起草、送审及其向社会公开征求意见等举措显示出我国教育立法、教育法治建设的一种新气象。这次教育修法经历了多个环节,历时三年有余,有关各方的重视程度和修法的民主、开放程度都是空前的。但是由于相关程序及相关各方自身条件的限制,教育立法工作的思路仍然不够开阔和宽广,远未达到"一揽子"的要求,立意不够高远,创新点不够多,改革驱动力不够强,有些表述(尤其是关于职业教育和现代国民教育体系的表述)不够妥贴。应当立足更高的层面、放眼更长远的目标,充分拓展思路,将教育修法与制定新的教育法律结合起来,尽快完善我国的教育法律体系,迎接全面依法治教时代的到来。 The draft, submission, consultation to the society and other measures of "Legal Education Package Amendment(Draft)" shows a new phenomenon of education legislation and construction in China. From several aspects, this education amendment cost more than three years and attracted unprecedented attention, democracy and opening degree. Because of the relative program and each party's restriction, the thinking of education legislation is still not wide and broad enough and did not meet the "package" requirement. It is lack of better idea, innovation, reform force and some expression(of vocational education and modern national education system). It should reach to a higher level, take a broad view, develop the thinking, combime the education law amendment with the new education law to improve the education legislation and welcome the era of managing education by law completely.
