数字出版物二手市场存在的合理性与可行性

无论是国际条约,还是我国《著作权法》,均未对发行适用的技术环境和作品载体形式做出限制性规定。事实上,只要数字出版物复制件的物权人能够以加密等技术手段保证转售以后只有一份复制件,根据权利穷竭原则,就不会发生侵权。从物权人利益实现、经济及公众获取作品途径等角度看,数字出版物二手市场的存在有其合理性。已有实例对其进行了探讨且现有技术也可以解决其争议的问题,一定程度上说明了其可行性。

Neither international treaty nor the copyright law in our country has restrictive provisions on issue of technical environment nor work carrier forms.In fact,according to intellectual property right exhaustion,as long as the copy holder can guarantee only exist one copy after resale by the technology as encryption,etc,infringement will never happen.From the perspective of proprietor＇s interest,economic and public access to work,the existence of secondary market of digital publications has its rationality.Existing instances and probes into the existing technologies can also solve the problem of the dispute,to a certain extent,shows its feasibility.
