论我国《监狱法》的修改与完善

On the Amendment and Perfection of the Prison Law in China

《监狱法》的修善应当以刑事一体化思想作为指导。在《监狱法》的具体修改内容上,应当分为协调问题、细化问题以及空白问题三类。协调问题又分为法律部门之间的协调,以及法律部门内部内容之协调问题。细化问题包括期间问题、经费问题、监狱工作人员的设置和分类问题等十三个方面。空白问题包括监狱企业、罪犯危险性评估、外籍犯管理等九个方面。

The amendment of Prison Law should be in accordance with the integration in criminal fields. On the detailed content to be modified,it should be divided into 3 parts： coordination problems,the details and the blanks. Coordination problems include departmental coordination and content coordination. Detailed content problems include period problems,cost problems,the staff＇s setting up and classifying,and other 10 aspects as well.The blank problems include prison enterprise,risk assessment of criminals,foreign criminals＇ management and other 6 aspects.
