检察视阈下外来人口犯罪的实证分析——以2005年至2014年T市B区检察机关审理的案件为样本

An Empirical Study on the Immigation Crime from the Perspective of Procuratorial Work——Take the Case heard by Procuratorial Organ as Analysis Sample in B District T City from 2005 to 2014

随着社会经济的不断进步和城市化进程的进一步发展,大量外来人口从经济欠发达地区涌入城市,随之而来的犯罪问题也日益凸显。为预防和减少外来人口犯罪,为区域经济社会发展营造出良好的法治和社会环境,T市B区检察机关在办案原始数据统计分析的基础上,以定性和定量分析相结合,对T市B区十年来外来人口犯罪情况进行分析研究,从两个层面提出防控对策建议。在刑事政策和犯罪调控层面,引入社会支持理论与社会控制的结合运用;加强对危害严重犯罪打击力度;强化社会治安综合治理。在社会政策和服务管理层面,建立外来人口社会保障制度,促进社会融入;完善外来人口服务管理措施,实行分级管理;创新外来人口居住地管理模式,实现自我管理。

With the continuous advancement and further development of the social economy of urbanization and a large number of migrants from underdeveloped areas into cities, crime attendant problems become increasingly prominent. For the prevention and reduction of immigration crime, to create a favorable legal and social environment for the regional economic and social development, on the basis of prosecutors in B District T City handling the raw data statistical analysis, and qualitative and quantitative analysis of B District T City decade immigration crime situation analysis research, prevention and control measures recommendations have been put forward on two levels. In the level of criminal policy and the regulation of crime, we should introduce social support theory combined with the use of social control, strengthen the hazards of serious crime crackdown, and strengthen social security comprehensive management. In the social policy and service management level, we should establish migrants＇ social security system, promote social inclusion, improve immigation service management measures and different levels of management, and innovate migrants residence management and self-management.
