152例护理所涉医疗损害责任纠纷案件的成因分析及赔偿分布

Cause Analysis and Compensation Distribution of 152 Cases of Nursing-related Medical Damage Liability Disputes

目的:分析护理所涉医疗损害责任纠纷案件的成因及赔偿分布情况。方法:纳入2008年7月至2015年2月中国裁判文书网中护理所涉医疗损害责任纠纷案件152例,对其一般情况、科室分布、医院责任、损害结局、纠纷成因及赔偿进行分析。结果:我国护理所涉医疗损害责任纠纷占总体纠纷案例的2.7%;损害结局以患者死亡比例最高,占61.2%;护理所涉医疗损害成因发生率和平均实赔金额前三位依次是用药错误、病情监测不力和护理操作不当。结论:护理所涉医疗损害责任纠纷案件总体发生率不高,但所造成的后果严重,有必要从以往的案例中吸取经验教训,建立更完善的护理安全制度与体系,保护患者安全,为护理人员创造安全职业环境。

Objective： to analyze the causes and compensation distribution of nursing-related medical damage liability disputes. Methods： Select 152 cases in web of Judicial Opinions of China from July 2008 to February2015, and analyze the general situation, distribution of departments, hospital responsibility, damage, causes of disputes and damage compensation. Results： nursing-related medical damage liability disputes constitute 2.7% of overall dispute cases, the most damage result of patients are death（61.2%）;The top three rate and average real compensate amount of nursing-related medical damage disputes are： medication errors,monitor failure, improper nursing operation. Conclusion： The overall occurance of nursing-related medical damage disputes is low, but the consequences are serious, therefore,it is necessary to learn the experience to build a more perfect nursing safety system, protect patients＇ safety and create a safety professional environment for nursing staff.
