摘要
民法学界通常倾向于研究用人者替代责任,而对用人者的权益却很少涉及,这与民法最基本的公平原则相背离,故本文在比较英美法系和大陆法系的立法模式基础上,分析我国用人者追偿权的现状,尝试对《侵权责任法》第34条进行重塑,最后从追偿方式、追偿比例及雇主责任保险制度三个方面对我国用人者追偿制度提出完善建议。
Civil law circles generally tend to research the employer's vicarious liability, but the interests of the employer are rarely involved, and this is contrary to civil fundamental principle of fairness. In this paper, the legislative basis for comparison mode common law and civil law analyzes the on current situation, try to remodel "Tort Liability Act" Article 34. Finally, from the recovery mode, recovery ratio and employers" liability insurance system for employment,we put forward a sound recovery system recommendations.
