高校学位授予权的合法性及其限度——基于哈贝马斯合法性理论的视角

The Legitimacy of the University Degree-granting and Its Limit——Based on the Perspective of Habermas' Legitimacy Theory

高校学位授予权是现代大学办学自主权中特殊的一种权力,有其特定的内涵。从哈贝马斯关于合法性的理论视角看待高校学位授予权,其合法性主要体现在大众支持、公平正义、与实践适应、存在于特定社会政治生活之中等多方面。实然的高校学位授予权,在实践中出现的诸多弊端,主要与高校本身自觉、行政运作方式、外部监督方面的限度相关。

The university degree granting right is a special kind of power in the autonomous right of running a university,which has its specific connotation. Based on the perspective of Habermas＇ theory,the university degree-granting shows its legitimacy on the public support,fairness,justice,adaptability and existence in certain social and political life. The university degree-granting has many disadvantages in practice,due to the limitations of university self-consciousness,administrative operation and external supervision.
