摘要
作为社会公平公正的重要组成部分,教育公平是社会公平在教育领域的体现和延伸。然而,一个国家在一定时期能够在多大范围内、多大程度上实现教育公平,乃受制于政治、经济、文化、法律等多种因素影响。从诸多的影响因素中抽取其一二来对此展开分析论述,有其独特的视阈和价值。笔者立足于十八届四中全会精神以及《国家中长期教育改革和发展规划纲要(2010-2020)》中关于加强教育法制建设的相关要求,从法律文本的角度出发,通过分析法治语境下教育公平的价值,试图探索实现教育公平的有效法制路径。
As an important part of social justice, educational fairness is a reflection and extension of social justice in the field of education; however, to what extent and in what degree a nation can realize educational fairness in a certain period of time is subject to political, economic, cultural, legal, and other factors, demanding different perspectives to be addressed. Focusing on the spirit of the fourth plenary session of the 18 th CCCP and the corresponding items on enhancing legalization of education listed on the National Mediumand Long-term Plan for Educational Reform and Development, this paper explores legal approaches leading to educational fairness in the context of rule by law through textual analysis.
