试论宪法惯例认可制度的构建

在英国,宪法惯例广泛存在并且在宪政实践中发挥重要的作用。学界围绕宪法惯例的研究已经数年,从最初对英国宪法惯例的引介到能够结合本土宪政资源开创宪法惯例研究新的空间,构建宪法惯例相关制度的条件已经颇为成熟。由于我国公民宪法素养和规则意识尚未健全,依靠国家机关自行创设宪法惯例并遵从宪法惯例易引起公民对宪法文本权威性的质疑,加之我国违宪审查制度至今未能发挥实效性,建立具有中国特色的宪法惯例认可制度至关重要。

In Britain,the constitutional convention is widespread and play an important role in constitutional practice.Scholars have researched the constitutional convention for several years.In the beginning,scholars committed to introducing the British constitutional convention,recently combine local resources to create a constitutional convention constitutionalism research new space,construct the system of constitutional convention related conditions are quite mature.Because our country citizen constitution accomplishment and consciousness of rules is not yet perfect,depend on the state organs to establish constitutional convention and follow constitutional convention easy cause civil authority questioned the constitutional text,and combined with the system of judicial review in China have been unable to play effectiveness,establish the system of constitutional convention with Chinese characteristics is of crucial importance.
