管制性征收抑或财产权的社会义务——从住宅小区道路公共化谈起

随着城市现代化的快速进程和我国城市规划理念的变革,"街区制"小区模式将成为我国住宅规划的新趋势。"街区制"小区政策的推行,必将造成传统住宅小区道路的公共化,这属于对小区业主区分所有权的法律限制,其法律性质不应属于财产权社会义务范畴,应构成公法上的管制性征收,因此,要求国家出台法律法规对其予以规制,这样才能实现小区财产权人的合法权益与社会公共利益之间的均衡。以财产权的社会义务理论为基础,以法释义学为分析工具,探讨住宅小区道路公共化的正当性基础,厘清管制性征收和财产权社会义务之间的法律边界,证成小区道路公共化的法律属性及其法律补偿。

With the rapid progress of urban modernization and the change of the idea of urban planning in our country, the pattern of ＂block system＂ will become a new trend of housing planning in China. Blocks of residential policy implementation, will cause the traditional residential district road and the public, which is for residential property owners to distinguish ownership of legal restrictions, its legal nature should not belong to the property rights of social obligation category, should constitute law of regulatory takings. Therefore, to seek the state promulgated laws and regulations to regulate, so as to achieve the balanced development between the residential property owners of the legitimate rights and interests of the social public interests. This paper is based on the theory of property right on social obligation, law explanation science as a tool to analyze, and to explore the basis of the legitimacy of communalization of residential district road, to clarify the legal boundaries between socialization of property right and quasi collection, to communalization of residential district and the justify the Legal nature of road Legal compensation.
