人民陪审员实质性参审的要求及实现

我国的人民陪审制度实践中陪审的形式化问题严重,"陪而不审,审而不议"的问题突出,问题解决之道是推进人民陪审员实质性参审。实质性参审强调人民陪审员参与案件审判活动并独立提出案件处理意见,从而在参审过程中真正发挥实质性的作用。实质性参审不足问题是人民陪审员制度改革的瓶颈,推进人民陪审员实质性参审要求切实加强人民陪审员队伍建设、陪审案件信息知情保障、合议庭法官对人民陪审员陪审案件所需法律知识与法律技能的服务与指导、人民陪审员独立发表意见保障、充分尊重人民陪审员的独立地位与陪审权利等方面的工作。

In the practice of our country＇s people＇s jury system, the problem of people＇s assessor＇s formal participation in trial is serious, the problem of people＇s assessor＇s ＂accompanying but not trying, trying but not deciding＂ is outstanding, the solution of the problems is to promote assessors to participate in trial substantively. Realization of substantial participation in trial emphasizes that people ＇s assessors should participate in the trial of the case and put forward handing suggestions independently, so as to play a real role in the process of participation in the trial. The problem of deficency in substantial participation is the bottleneck of the reform of the people＇ jury system, and it is necessary to strengthen the team construction of people＇ assessors, assure assessor＇s knowing the information of the case, emphasize bench judge＇s service and guidance to the people＇s assessors, ensure independent opinion＇s publication of assessors and to fully respect assessor＇s independent status and right of participation in trial, etc.
