强奸罪的基本属性,即财产属性、道德属性、权利属性凝练并集中反映了不同历史时期,强奸罪之所以具有不同历史使命以及呈现不同存在状态的各种社会因素,它们是将强奸罪产生与发展所依托的社会基础与强奸罪以及强奸罪立法有机联系在一起的桥梁与纽带。财产属性与权利属性实则代表不同的强奸罪设置与认定的理念:财产属性强调的是性利益的他人支配性;权利属性强调的是性利益的自主支配性。从财产属性到权利属性,随着这种认定理念的转变,强奸罪的方方面面都随之发生了变化。围绕着强奸罪所发生的这种种变化以及在强奸罪的认定过程中所形成的有别于其他犯罪的特殊规则均可以通过强奸罪的基本属性之间的纵向与横向关系作出合理解释,其正当性均可以通过财产属性向权利属性过渡的进步性以及性道德存在的必要性予以说明。

The basic attributes of rape, the attribute of property, the attribute of morality and the attribute of right explain and reflect the reason why rape has different missions and different states of existing. They are the bridge and link which associate the social basis of rape with rape legislation. The attribute of property and the attribute of right actually represent different ideas of setting and recognition of rape. The attribute of property emphasizes the domination of sexual interest by other people. The attribute of right emphasizes sexual autonomy which means a person dominates sexual interest by herself/himself. With the transformation of the idea, all aspects of rape will change accordingly. All these changes and unique rules of rape can be explained through vertical and horizontal relationships among basic attributes of rape. The legitimacy of all the changes can be proved through the progress of transition from the attribute of property to the attribute of right and the necessity of sex morality.
