基于成本与收益视角下的著作权合理使用效益研究

Research on the Benefits of Copyright Fair Use from the Perspective of Costs and Benefits

从成本与收益的角度,研究著作权中合理使用的经济效益和社会效益,指出著作权的合理使用不仅可以提高著作权人收益,而且也可以扩大作品的宣传,增加社会公众对著作权作品的接触与利用,有利于社会公共文化的繁荣与发展,符合帕累托标准。为著作权中合理使用制度的修订提供理论参考依据。

From the perspective of costs and benefits,this paper conducted a study of the economic benefits and social benefits of copyright,it pointed out fair use of copyright could not only increase earnings of copyright owners,but also expand works publicity,increased the public＇ s contact and use of copyright works,thus it was conductive to the prosperity and development of public culture,in line with Pareto Criterion. This research could be a theoretical reference for the revision of copyright fair use system.
