网盘服务提供商的版权侵权责任研究

随着互联网技术的发展与普及,直接追究侵权人个人责任十分困难,因此追究网盘服务提供商的"间接侵权"责任已成为新的诉讼途径,但由于"避风港原则"的庇护,该间接侵权责任很难认定。随着司法实践的推进,"红旗标准"成为认定网盘服务提供商是否具有主观过错以及其间接侵权责任的重要依据,也为网盘服务提供商承担民事责任、刑事责任、行政责任提供判断的基础。

Due to the development and popularization of internet technology,it is very difficult to directly find out who is to be blame.What has become of the new lawsuits way is that service providers of network disk should be accountable for “indirect infringement”.But because of the protection of “Haven principle”,the responsibility is difficult to be identified indirectly.With the advance of the judicial practice,“Red Flag standard”breaks through the protection of the “Haven principle”in confirming service provider of network disk＇s subjective fault.“Red Flag standard”has became a important condition to confirm service provider of network disk＇s indirect infringement,and a basis to judge service provider of network disk＇s civil liability,criminal liability,even administrative responsibility.
