废弃电器电子产品处理基金的立法经验与法制建议

Legislative Experience and Legal Suggestion On Waste Electrical and Electronic Equipment Treatment Fund

随着电器电子产品用量的增加及产品周期的缩短,废弃电器电子产品大量产生,成为全球关注的焦点。美国、德国、日本、荷兰、瑞士等结合本国国情建立了不同的废弃电器电子产品处理基金模式。我国2009年颁布的《废弃电器电子产品回收处理管理条例》明确规定国家建立废弃电器电子产品处理基金,用于废弃电器电子产品回收处理费用的补贴。2012年,我国废弃电子产品处理基金正式成立,应当借鉴国外立法经验,结合我国国情,进一步完善基金的征收、使用与监管。

With the Increasing of the amount of electrical and electronic equipment and shortening the product cycle, waste electrical and electronic equipment has become the focus of global attention. The United States, Germany, Japan, Holland and Switzerland establish different models of waste electrical and electronic equipment treatment fund model combining with their own national conditions. Waste electrical and electronic equipment recycling management regulations in 2009 clearly stipulates that the state to establish a waste electrical and electronic equipment treatment funds for waste electrical and electronic equipment recycling costs of subsidies, Chinese waste electrical and electronic equipment treatment fund was formally established in 2012. China should learn from foreign legislative experience, combined with China＇s national conditions to further improve the collection, use and supervision of the fund legal system.
