我国社会保险基金信托管理法律制度研究

Research on Legal System of Trust Management of Social Insurance Fund in China

社会保障制度是当代社会文明的标志之一,社会保险基金是保证社会保障制度正常运行的支柱,而选择正确的社会保险基金管理方式则是社会保险基金持续发展的关键。在当前环境下,我国社会保险基金采用信托管理的方式不失为一种可行路径。通过对我国社会保险基金管理存在的问题以及域外关于社会保险基金信托管理的实践分析,指明我国社会保险基金信托管理的必要性,在此基础上为我国社会保险基金信托管理模式提出些许建议,力图使我国社会保险基金管理更加安全、合理、有序。

Social security system is one of the symbols of modern social civilization,social insurance fund is the pillar of guaranteeing the normal operation of the social security system,and the choice of proper social insurance fund management is the key to the sustainable development. Under the current environment,it is a feasible way to adopt the trust management of the social insurance fund in our country. Through the analysis of the problems in the management of social insurance fund in China and the management practice abroad,the paper points out the necessity of this trust management,on the basis of which it puts forward some suggestions for social insurance fund trust management model,trying to make the management of social insurance fund more safe,reasonable and orderly in China.
