对检察指令权进行程序性规制是协调检察官独立与检察一体关系,确保检察官独立性的重要举措。我国检察指令权的运作存在规范性不足、透明度不强等问题,应在遵循检察规律原则、法治原则、透明原则的基础上,从检察指令的信息保障、检察指令的书面附理由程式、检察指令的公开、检察指令的沟通交流机制、检察指令实现机制的规制以及检察指令争议的裁决机制等方面加强对检察指令权的程序性规制。

One of the most important parts of enhancing prosecutors' independence and balancing between prosecutors' independence and procuratorial integrity is the procedural regulation of procuratorial directive power. Currently,it is necessary to push the procedural regulation of procuratorial directive power in China. The procedural regulation of procuratorial directive power should be carried out from the aspects of the information assurance,the publicity,the negotiation mechanism,the regulation of the procuratorial directive realization mechanism and the judgement of the procuratorial directive dispute under the principles of transparency and rule of law.
