Compulsory Lawyer Agency System under Perspective of the New Judicial Explanation of Civil Procedure Law

2015年2月4日出台的《民诉法司法解释》第85条扩大了"近亲属"的概念,意在进一步保护当事人的诉讼权利。面对当今司法实践中普遍存在的诉讼代理不规范、诉讼效率低下、当事人利益得不到充足保障等问题,应创立一种高效、专业的诉讼代理机制。律师强制代理作为解决方法之一,在某些特定类型案件中有着适用的可能性和必要性。通过确定适用案件类型、扩大法律援助的适用以及实现法律服务群体的角色转变,能够使律师强制代理在我国民事诉讼领域找到根植的土壤。

The new Judicial Explanation of Civil Procedure Law was established in 4th Feb. 2015. It expand the definition of ＂close relatives＂ , which aims at protecting litigant＇ s litigious rights further. To deal with the problems like non - standardized advocacy, low efficiency and insufficient protection of litigant＇ s rights, there should be a high - efficient advocacy system. Com- pulsory lawyer agency system, as a way to solve such problems, has its necessity and possibility in some certain kind of cases. By determining the range of application, extending the channel of legal aid system and changing the role of legal professionals, com- pulsory lawyer agency system could find a development path that fits China＇ s national conditions.
