From Relief to Incorruption:An Exploration on Petition's Incorruption Function

信访制度功能法治化是信访法治化改革的基础。在全面从严治党和反腐败斗争中,应该逐渐淡化信访制度的权利救济功能,强调信访制度的廉政功能。实践中,信访已越来越多地成为提供案源线索和监督信息的廉政信息渠道。从应然层面上看,信访制度的廉政功能是法治价值引导的制度必然。因此,在新时期,要充分发挥信访制度的廉政功能,完善纪检、监察信访工作机制,制定统一的《信访法》,建立起廉政信访信息评估和防范机制。

The petition system function under the rule of law is the foundation of the petition reform under the rule of law.In comprehensively governing Party strictly and anti-corruption struggle,it should gradually dilute petition＇s right relief function and emphasize the petition system＇s incorruption function.In practice,petition has more and more become an incorrupt information channel of offering case source clues and supervision information.In the view of the ought-to-be level,the petition system＇s incorruption function is the system necessity led by value under the rule of law.Therefore,in the new period,it should give full play to the petition system＇s incorruption function,improve the discipline inspection,monitor the petition work mechanism,formulate the unified Petition Law and establish the incorrupt petition information evaluation as well as early-warning mechanism.
