集体经营性建设用地入市收益分配法律问题研究 被引量:12

摘要 集体经营性建设用地入市已正式进入试点阶段,而收益分配又是集体经营性建设用地入市的核心问题。各地试点经验反映出集体经营性建设用地流转收益分配面临政府部门是否参与分配、"成员权"的内涵界定不清、规划限制下不同土地权利人的利益难以平衡、收益分配缺乏理论依据和实践经验、对入市后收益的分配和使用缺乏应有的监督和规范的管理等问题。针对以上问题,从兼顾公平与效率的角度,提出"一次分配基于产权,二次分配政府参与"、界定"成员权"的实质标准、对集体建设用地所有权和使用权进行确权颁证、以农业补贴和税收方式实现规划限制下不同土地权利人之间利益均衡、以条例规则规范收益分配、以行政规范监督政府和集体收益后的用途六项措施。 The collective business constructive land entering market has officially entered the pilot phase,and income distribution is the core issue of collective business constructive land entering market. The experience of other pilots reflected that government departments whether should be involved in collective management of construction land transferring income distribution,the connotation of ' member rights' was unclearly defined,the interests of different people's land rights under the plan difficult to balance restrictions,profit distribution lacked theoretical basis and practical experience,how to distribute and use the income after the market lacked supervision and regulation management and so on. In terms of above the questions,considering the equity and efficiency,there are six measures that ' one assignment based on property rights,redistribution of government involvement',defining the substantive standards of ' member rights',indeed the collective construction land ownership and use rights and certifying,agriculture subsidies and tax planning restrictions under way to achieve the balance of interests between different land rights,rules and regulations to regulate income distribution,administrative specification to supervise the use of the income of the government and collective organizations.
