摘要
我国于2014年施行的新《中华人民共和国消费者权益保护法》(以下简称《消法》)加强了对消费者权益的保护,如规定了消费者通过网购等方式购买商品可"七天无理由退货"等。但因我国对网络代购消费者权益尚未形成系统的保护,网络代购业务大部分都以个人卖家采购操作,消费者的公平交易权仍然面临着保护方面的挑战与侵害。故拟从非现货个人网络代购出发,研究提出从限制代购人对合同的任意解除权、完善惩罚性赔偿制度、延长无理由退货期间等几个方面完善网络代购基础制度,更全面的保护消费者在网络代购中的公平交易权。
The protections of consumers’ rights have been strengthened by the new "People’s Republic of China Consumer Protection Law"in the year 2014,for example,rules for consumers about online shopping goods can be "returned within seven days without any reason",etc. Because those protective rules haven’t been well formed into systems,and internet shopping business are mostly made by individual sellers procurement operations,and consumers’ fair trading rights is still facing challenges and abuse protection. From the perspective of non- spot purchase personal internet shopping,this paper makes recommendations on the improvement of the basic system for online purchasing from the aspects including the restriction on the purchasing agency’s right of termination without any reason,improvement of the punitive compensation system,extension of the period of the return without any reason,etc. By doing so,consumers’ fair trading rights are more fully to be protected in internet shopping services.
