摘要
随着消费者在食品消费方面对便捷消费、健康消费、放心消费等方面提出了更高的要求,网络销售食品应运而生。网络食品销售是一种重要的电子商务模式。由于网络食品销售方式的特殊性,虽然我国修改并颁布了新的《食品安全法》,但在实践中自制食品、土特产、订餐平台等网络食品的安全认定、销售监管及责任承担存在复杂性,导致网络销售的食品在一定程度上威胁食品安全。要促进网络食品销售模式的发展,又要保障网络销售食品的安全,就要从法律制度和责任承担入手,探索完善网络食品销售行为规范法律,健全网络食品销售主体资格认定制度;实现销售者和消费者网络环境下共盈。
When the consumers put forward higher requirements for the convenient, healthy and worry - free consump- tion of food consumption, selling food online come into being. Selling food online is a kind of important electronic business model. Due to the special nature of selling food online, although China revised and promulgated the new " food safety law", there are? the? complexities in security identification, sales supervision and responsibility of home- made food, native products, and ordering platform online in practice, which leads to selling food online threats food safety to a certain extent. If we want to promote the development of mode and guarantee its security of selling food on- line, we should start from the legal system and responsibility, explore and improve the legal norms of selling food on- line, perfect the system of the qualification of selling food online, and achieve all - win of sellers and consumers un- der the network environment.
