基于语料库的中美立法文本古体副词使用探究——以“hereby”的使用为例

Archaisms in Chinese and American Legislative Texts:A Corpus-based Study on“Hereby”

自建两个各包含约138万个语料的法律英语语料库,利用AntConc语料分析软件检索并分析了"hereby"在两个语料库中用法的异同。在此基础上,提出"hereby"在中国法律英译或法律写作中的4种使用策略,即严肃性标志、理据性标志、规范性运用和灵活性运用。

Under the influence of The Plain English Campaign,Archaism usage in legal English is reduced to only some of commonly used ones.In order to study archaisms in legal English,this paper analyzes the usage of＂hereby＂by means of AntConc on the basis of 2self-built corpora that has a total of 1.3million words respectively.Based on the findings,the paper then proposes 4strategies to use＂hereby＂in legal translation or legal writings,namely,using＂hereby＂to preserve solemnity;using＂hereby＂to indicate specific documents or words;using＂hereby＂in fixed sentence structures;using＂hereby＂more flexibly in legal English.
